Terms and Conditions for the Skipper Training Organised by Maxi Nautika Ltd

  1. Introduction

Welcome to MAXI NAUTIKA D.O.O. (hereinafter referred to as „Maxi Nautika or us“ or „the Agency“). These Terms and Conditions govern the relationship between the Agency and its clients (hereinafter referred to as „the Client or you“). By booking a sailing holiday through the Agency, the Client agrees to be bound by these Terms and Conditions.

Skipper training means practicing specific and defined maritime knowledge on a sail or power-driven vessel under our supervision and organization.

  1. Evidence of Contract

The evidence of the contract between you and us is the completed booking form and the full amount of funds landed in our bank account, which are sent by you as an advance payment. Bank transfer is the only method of payment for the costs of the skipper training.

  1. Changes to Your Skipper Training

Once confirmed, you will not be entitled to change the type or date of the skipper training. We will do our best to fit your needs if practicable.

  1. Changes by Client

We will make all efforts to reschedule you to the next available opportunity, and we reserve the right to levy a 10% change re-booking fee.

  1. Cancellations by Client

You may cancel your skipper training at any time, but cancellation fees apply as follows:

  • Over 60 days before your skipper training: 25% of the total skipper training fee (half your deposit).
  • Between 30 and 60 days before your skipper training: 50% of the total skipper training fee.
  • Less than 30 days before your skipper training: The total skipper training fee.

Cancellations must be notified to us without delay in writing or by email. Cancellation costs are calculated from the date we receive your cancellation. This may be totally or partially suspended if we can re-sell your spot, in which case we will refund the amount recovered, less a 10% cancellation fee.

Our Cancellations

We reserve the right to cancel a skipper training at any time. In such cases, we will refund all amounts paid by you to us in respect of the provision of the skipper training. The Client  is not entitled to compensation for any other costs and damages.

  1. Deposits

To reserve a place on the skipper training, a deposit of 50% of the total skipper training fee must be paid. In the event of cancellation, half of the deposit amount is non-refundable to cover our administrative costs.

  1. Payment

The full price of the skipper training must be paid 30 days before the confirmed starting date to the account owned by Maxi Nautika. Payment must be made by bank transfer, and the Client accepts responsibility for all bank transfer fees. If these costs are not covered by the Client, it will be considered that the payment has not been fully settled, and the Client will have to pay the remaining amount to Maxi Nautika.

  1. Legal Obligations

The Client is exclusively responsible for complying with all laws, regulations, orders, demands, and requirements of the Republic of Croatia. We will not be liable to the Client in any way in connection with obtaining the necessary documents or complying with any such law, regulation, order, demand, request, or instruction, whether given orally or in writing, or for the consequences arising from your inability to obtain such documents or your failure to comply with such laws, regulations, orders, requests, demands, or instructions.

  1. Crew List

Croatian regulations do not allow anyone who is not registered on the Crew list to be carried aboard the vessel. You are responsible for correctly filling out the data for the Crew list no later than 10 days before the first day of skipper training. You are responsible for the accuracy of the submitted data and the validity of all required documents, such as passports, licenses, and other identification documents.

  1. Travel Documents

You are responsible for possessing, disposing, and presenting documents such as entry visas, health documents, and other documents required by the laws, regulations, and requirements of the Republic of Croatia. If your documents are not in accordance with such laws, regulations, orders, or requirements, we reserve the right to refuse to provide skipper training services to you.

  1. Changes to Skipper Training

We will make every effort to provide skipper trainings as published. However, if there are bad weather conditions, illness of an instructor, or other operating difficulties, we reserve the right to change the program/itinerary, instructor, and vessel to ensure that the change is of equal or better quality.

  1. Conduct Aboard Skipper Training Vessel

If you behave in a way that endangers the persons, vessel, or property on board, or act in a disorderly manner, we may take necessary measures to stop such behavior, including disembarkation from the vessel. You may be prosecuted for offenses committed on board. You agree to follow the orders of the Skipper or Instructor at all times.

  1. Complaints

Please inform your instructor as soon as possible if you are dissatisfied with any aspect of the training, including the instructor’s work. If you believe that the service is not as expected, and your previous appeal to the instructor did not resolve the issue, please send your complaint directly to Maxi Nautika via email at info@croatiasailing4you.com. We will confirm receipt of your complaint and respond within 14 days.

  1. Injury and Death

Accidents can happen during skipper training. Be aware that sailing and boating, as well as skipper training and life on motor and sailing boats, catamarans, powerboats, and all types of sea-going vessels, is potentially dangerous activity. Ensure you have travel insurance to cover medical expenses and repatriation if necessary. You are responsible for obtaining the travel insurance described. We cannot be held responsible for any injury or death during our skipper training, except for our responsibilities under relevant Croatian maritime laws and the findings of an official Croatian maritime investigation.

  1. Arbitration of Disputes

In the event of a dispute regarding skipper training that the parties cannot resolve amicably, the parties accept the jurisdiction of the court in Rijeka.

  1. Personal Data Protection

Maxi Nautika handles your personal information according to the Privacy Policy on our website https://www.croatiasailing4you.com/privacy-notice.

  1. Photographs

We may use photographs, videos, and other images made during skipper training for publicity and promotional purposes, but we will ask for your consent before the course begins.

  1. Acknowledgement

By returning the completed booking form and paying a deposit, you signify your agreement to these terms and conditions.
