Terms and Conditions for the Skipper Courses Organised by Maritime Center Mare Ltd in Cooperation with Maxi Nautika Ltd

  1. Introduction

Welcome to MAXI NAUTIKA D.O.O. (hereinafter referred to as „Maxi Nautika or us“ or „the Agency“). These Terms and Conditions govern the relationship between the Agency and its clients (hereinafter referred to as „the Client or you“). By booking a sailing holiday through the Agency, the Client agrees to be bound by these Terms and Conditions.

Skipper courses mean tuition of all the prescribed elements of navigation and seamanship and associated facilities provided and organized by Maritime Center Mare (Rijeka, Verdijeva 7, Croatia), approved by the MINISTRY OF MARITIME AFFAIRS, TRANSPORT AND INFRASTRUCTURE OF THE REPUBLIC OF CROATIA and CROATIAN REGISTER OF SHIPPING, and conducted in accordance with the requirements of article 52. of the Regulations of boats and yachts (National Newspaper NN #27/2005). It is a prerequisite for a person to be able to take the relevant exam in the Harbor Master’s office.

  1. Evidence of Contract

The evidence of the contract between you and us is the completed booking form and the full amount of funds landed in our bank account, sent by you as an advance payment. Bank transfer is the only method of payment for the costs of the skipper course.

  1. Changes to Your Skipper Course

Once confirmed, you will not be entitled to change the type or date of the skipper course. We will do our best to accommodate your needs if practicable.

  1. Changes by Client

We will make all efforts to reschedule you to the next available opportunity and reserve the right to levy a 10% change re-booking fee.

  1. Cancellations by Client

You may cancel your skipper course at any time, but cancellation fees apply as follows:

  • Over 60 days before your skipper course: 25% of the total skipper course fee (half your deposit).
  • Between 30 and 60 days before your skipper course: 50% of the total skipper course fee.
  • Less than 30 days before your skipper course: The total skipper course fee.

Cancellations must be notified to us in writing or by email. Cancellation costs are calculated from the date we receive your cancellation. This may be totally or partially suspended if we can re-sell your spot, in which case we will refund the amount recovered, less a 10% cancellation fee.

  1. Our Cancellations

We reserve the right to cancel a skipper course at any time. In such cases, we will refund all amounts paid by you to us in respect of the provision of the skipper course. The Client  is not entitled to compensation for any other costs and damages.

  1. Deposits

To reserve a place on the skipper course, a deposit of 50% of the total skipper course fee must be paid. In the event of cancellation, half of the deposit amount is non-refundable to cover our administrative costs.

  1. Payment

The full price of the skipper course must be paid 30 days before the confirmed starting date directly to Maritime Center Mare. Payment must be made by bank transfer, and the Client accepts responsibility for all bank transfer fees. If these costs are not covered by the Client, it will be considered that the payment has not been fully settled, and the Client will have to pay the remaining amount.

  1. Legal Obligations

The Client is exclusively responsible for complying with all laws, regulations, orders, demands, and requirements of the Republic of Croatia. We are not liable for obtaining necessary documents or complying with any such law, regulation, order, demand, request, or instruction, and for the consequences arising from your inability to obtain such documents or your failure to comply with such laws, regulations, orders, requests, demands, or instructions.

  1. Crew List

Croatian regulations do not allow anyone who is not registered on the Crew list to be carried aboard the vessel. You are responsible for correctly filling out the data for the Crew list no later than 10 days before the first day of the skipper course. You are responsible for the accuracy of the submitted data and the validity of all required documents, such as passports, licenses, and other identification documents.

  1. Travel Documents

You are responsible for possessing, disposing, and presenting documents such as entry visas, health documents, and other documents required by the laws, regulations, and requirements of the Republic of Croatia. If your documents are not in accordance with such laws, regulations, orders, or requirements, we reserve the right to refuse to provide skipper course services to you.

  1. Changes to Skipper Course

We will make every effort to provide skipper courses as published. However, if there are bad weather conditions, illness of an instructor, or other operating difficulties, we reserve the right to change the program/itinerary, instructor, and vessel to ensure that the change is of equal or better quality.

  1. Conduct Aboard Skipper Course Vessel

If you behave in a way that endangers the persons, vessel, or property on board, or act in a disorderly manner, we may take necessary measures to stop such behavior, including disembarkation from the vessel. You may be prosecuted for offenses committed on board. You agree to follow the orders of the Skipper or Instructor at all times.

  1. Complaints

If you are dissatisfied with any aspect of the course, inform your instructor as soon as possible. If the issue is not resolved, send your complaint to Maxi Nautika via email at info@croatiasailing4you.com. We will confirm receipt of your complaint and respond within 14 days.

  1. Injury and Death

Be aware that sailing and boating involve potentially dangerous activities. Ensure you have travel insurance covering medical expenses and repatriation. We are not responsible for injury or death during our skipper course, except under relevant Croatian maritime laws and regulations.

  1. Arbitration of Disputes

In the event of a dispute that cannot be resolved amicably, the parties accept the jurisdiction of the court in Rijeka.

  1. Personal Data Protection

Maxi Nautika handles your personal information according to the Privacy Policy on our website

  1. Photographs

We may use photographs, videos, and other images made during courses for promotional purposes, but we will ask for your consent before the course begins.

  1. Acknowledgement

By returning the completed booking form and paying a deposit, you signify your agreement to these terms and conditions.
