Terms & Conditions for the skipper course organised by

Maritime Center Mare Ltd in cooperation with Maxi Nautika Ltd

Definitions

In these terms and conditions, note that:

Maxi Nautika,"We","our","us" means Maxi Nautika Ltd

Client,"You", "your", means the person whose name is on the completed booking form on our web page https://www.croatiasailing4you.com.

Skipper course” means tuition of all the prescribed elements of navigation and seamanship and associated facilities provided and organized by Maritime Center Mare ( Rijeka, Verdijeva 7, Croatia), approved by: MINISTRY OF MARITIME AFFAIRS, TRANSPORT AND INFRASTRUCTURE OF REPUBLIC OF CROATIA CROATIAN REGISTER OF SHIPPING, and conducted in accordance to the requirements of article 52. of the Regulations of boats and yachts (National Newspaper NN #27/2005) and it is a prerequisite for a person to be able to take the relevant exam in the Harbor Master's office.

Evidence of Contract

The evidence of the contract between you and us is the completed booking form and full amount of founds landed on our bank account, which are sent from you as advance payment. Bank transfer is the only method of payment for the costs of the skipper course.

Changes to your skipper course

Once confirmed, you will not be entitled to change the type of skipper course nor to change the date of the skipper course. We will do our best to fit your needs, if practicable.

Changes by client

We will make all efforts to reschedule you to the next available opportunity, and we reserve the right to levy a 10% change re-booking fee.

Cancelations by client

Client may cancel its skipper course at any time, but than shall be charged and paid to us for the cancellation in the amount of:

Over 60 days before your skipper course:

25% of the total skipper course fee (i.e.: half your deposit)

Between 30 and 60 days before your skipper course:

50% of the total skipper course fee

Less than 30 days before your skipper course:

The total skipper course fee

Cancellations must be notified to us without delay in writing or by email. The basis for the settlement of accounts of the cancellation costs shall be calculated from the date we receive your cancellation. This may be totally or partially suspended if we are able to re-sell your spot. In this case, we will refund you the amount we have been able to recover, less a 10% charge cancellation fee.

Our cancelations

We reserve the right to cancel a skipper course at any time. In that case, we will refund all the fund amount paid by you to us in respect of the provision of the skipper course.

Deposits

For the reservation of a place on the skipper course, a deposit in the amount of 50% of the total skipper course fee has to be paid. In the event of cancelation, half of the deposit amount is not refundable as it covers our administrative costs

Payment

30 days before the confirmed starting date of a skipper course, all the price must be fully paid to the account owned by Maxi Nautika . The cost of Skipper course shall be paid by bank transfer. In doing so, the Client accepts that he will pay the full costs and fees of the bank transfer. These costs means the bank transfer fees of both the outgoing and the incoming bank, and it is what the client should emphasize to his bank when making the payment. If the client does not do this and Maxi Nautika is charged for the transfer costs, it will be considered that the payment has not been fully settled, and the client will have to pay the remaining amount to Maxi Nautika.

Legal obligations

Client is exclusively responsible for complying with all laws, regulations, orders, demands, requirements of Republic Croatia. We will not be liable to the client in any way in connection with obtaining the necessary documents or complying with any such law, regulation, order, demand, request or instruction, whether given orally or in writing or otherwise, or for the consequences arising from your inability of obtaining such documents or your failure to comply with such laws, regulations, orders, requests, demands or instructions.

Crew list

Regarding Crew list, keep in mind that Croatian regulations do not allow to anyone who is not registered in the Crew list to be carried aboard the vessel.

You are responsible for correctly filling out the data for the Crew list, no later than 10 days before the first day of skipper course. It's a client’s responsibility for the accuracy of the submitted data on the crew list, as well as for the validity of all documents requested from us such as passports, licenses and other identification documents.

Travel documents

The client is responsible for the possession, disposal and, possible presentation of documents such as, entry visas, health documents and other documents prescribed by the laws, regulations and requirements of the Republic of Croatia.

If the client's documents are not in accordance with such valid laws, regulations, orders, requirements or the client does not comply with them, then we reserve the right to refuse to provide skipper course services to that client.

Changes to skipper course

We will make every effort that we can to provide skipper courses as published. On the other hand, if there is a bad weather condition, illness of one of our instructors and similar situation, or we are having other operating difficulties, then we reserve the right to change the program/itinerary of a skipper course as well as instructor and the vessel aiming that the change is of equal or better quality.

Conduct aboard skipper course vessel

If, in our opinion, on the vessel where the skipper course takes place, you behave in such a way as to endanger the persons on the said vessel, the vessel itself or the property on it, or acting in a disorderly manner or in a manner to which other attendants of the skipper course may reasonably complain, we may take such necessary measures that will stop you from further acting in such manner including your disembarkation from the skipper course vessel. For the offenses committed on board a vessel, You may be prosecuted. You agree to follow the orders of the Skipper or Instructor who is in charge of the skipper course vessel at all times.

Complaints

Please inform your instructor as soon as possible if you are dissatisfied with any aspect of the course, including the instructor's work.

If you believe that the service is not as expected, and that your previous appeal to the instructor did not give you the expected result, please send the complaint directly to Maxi Nautika, more precisely by email at https://info@www.croatiasailing4you.com.

Maxi Nautika will confirm in writing every receipt of such a complaint in the same way we received the complaint. We will respond to your complaint within 14 days of receiving the complaint.

Injury and death

Accidents can happen during skipper course. Be aware that sailing and boating, as well as skipper course and in general life on the motor and sailing boats, as well as catamarans, powerboats and all types of sea going vessels is potentially dangerous activity. In this regard, please ensure that you have travel insurance to cover you during your stay on the Skipper course vessel, which would cover all medical expenses and repatriation if necessary. You are responsible for obtaining the travel insurance described. We cannot be held responsible for any injury or death during our skipper course, except for our responsibilities under the relevant Croatian maritime laws, regulations, orders, demands, requirements, and the finding of an official Croatian maritime investigation.

Arbitration of Disputes

In the event that there is a dispute regarding skipper course that the parties cannot resolve by any other friendly way, in that case the parties accept the jurisdiction of the court in Rijeka

Photographs

We may use photographs, videos and other images made during courses for publicity a other promotional purposes, but we will ask you for the signet consent before the beginning of the course.


Acknowledgement

By returning in completed booking form and paying a deposit, you signify your agreement to these therms and conditions.
