Terms and conditions for Yacht charter

1. Introduction

Welcome to MAXI NAUTIKA D.O.O. (hereinafter referred to as "the Agency"). These Terms and Conditions govern the relationship between the Agency and its clients (hereinafter referred to as "the Client"). By booking a sailing holiday through the Agency, the Client agrees to be bound by these Terms and Conditions.

2. Role of the Agency

The Agency acts solely as an intermediary for the chartering of yachts, including catamarans and motor and sailing boats, from various charter companies in Croatia (hereinafter referred to as "the Charter Company"). The Agency arranges for the crew of the boat if requested, intermediates courses to obtain skipper licenses, and organizes practical training courses on any yacht type. The Agency does not own or operate any yachts.

3. Charter Agreement

All yacht charters are subject to the specific Terms and Conditions of the Charter Company. The Charter Company's Terms and Conditions will be provided to the Client upon booking. The Client must review and agree to the Charter Company's Terms and Conditions before the booking is confirmed.

4. Payments

Clients will pay all prices and fees directly to the Charter Company if not required by specific Cherter that the prices are payid through the Agency to the Charter Company. In such a case, the Agency is only an intermediary and payment point, but all payment conditions are determined by the Charter Company charter. The Agency does not handle payments for yacht charters. The Client is responsible for ensuring that all payments are made according to the Charter Company's payment terms.

5. Booking Process

To book a sailing holiday, the Client must:

  • Provide the Agency with their preferences and requirements.

  • Review the options presented by the Agency.

  • Confirm their booking by agreeing to the Charter Company's Terms and Conditions.

  • Arrange payment directly with the Charter Company.

6. Intermediation of Skipper Courses and Training

The Agency offers intermediation services for skipper courses to help clients obtain the necessary licenses. The Agency also organizes practical training courses on various yacht types. These services are subject to the specific Terms and Conditions of the courses or training providers, which will be provided to the Client upon booking. The Client must review and agree to these Terms and Conditions before the booking is confirmed.

7. Cancellation and Amendments

Any cancellations or amendments to the booking must be made in accordance with the Charter Company's cancellation and amendment policies. The Client should contact the Charter Company directly to request any changes. The Agency is not responsible for any fees or penalties resulting from cancellations or amendments. Tthe client is not entitled to reimbursement of any other costs and damages against Agency. All boat charter conditions and related claims are governed exclusively by the terms and conditions of the specific charter company from which the client charters the boat.

8. Responsibilities of the Client

The Client is responsible for:

  • Reviewing and agreeing to the Charter Company's Terms and Conditions.

  • Making all necessary payments directly to the Charter Company.

  • Providing accurate and complete information to the Agency and the Charter Company.

  • Adhering to the rules and regulations of the Charter Company and the local maritime authorities.

9. Liability

The Agency is not liable for any damages, losses, or injuries incurred during the charter of the yacht or during the courses. The Charter Company and training providers are responsible for providing a safe and seaworthy vessel and for the conduct of the crew. The Client must address any claims or disputes directly with the Charter Company or the training providers.

10. Disclaimer

The Agency does not guarantee the availability of any specific yacht, the performance of any Charter Company, or the outcomes of any training courses. The Agency is not responsible for any errors or omissions in the information provided by the Charter Company or training providers. The Client agrees to hold the Agency harmless for any claims, damages, or losses arising from the use of the services provided.

11. Governing Law

These Terms and Conditions are governed by the laws of Croatia. Any disputes arising from these Terms and Conditions or the Client's use of the Agency's services shall be resolved in the courts of Croatia.
